Parliamentary Rule on the Use of the National Assembly Library of Thailand
B.E. 2565 (2022)

Whereas it is deemed expedient to revise the Parliamentary Rule on the Use of the National Assembly Library of Thailand to ensure its orderly, appropriate, and efficient use;
By virtue of Section 15 paragraph one of the Parliamentary Official Administrative Organization Act, B.E. 2554 (2011), the Parliamentary Officials Commission hereby issues the Parliamentary Rule on the Use of the National Assembly Library of Thailand as follows:

Clause 1. This Rule is called the “Parliamentary Rule on the Use of the National Assembly Library of Thailand, B.E. 2565 (2022)”.

Clause 2. This Rule shall come into force as from the day following the date of its publication in the Government Gazette.

Clause 3. The Parliamentary Rule on the Use of the National Assembly Library of Thailand B.E.2543 (2000) shall be repealed.

Clause 4. In this Rule:

“Director” means Director of the Bureau of Academic Services, the Secretariat of the House of Representatives;

“Member of the National Assembly” means Member of the House of Representatives and Senators as stipulated in the Constitution of the Kingdom of Thailand, B.E. 2560 (2017);

“Ordinary parliamentary official” means an ordinary parliamentary official as stipulated in the Parliamentary Officials Administration Act, B.E. 2554 (2011) including government employees and employees of the government agencies of the National Assembly;

“Political parliamentary official” means a political parliamentary official as stipulated in the Parliamentary Officials Administration Act, B.E. 2554 (2011);

“Parliamentary relevant person” means a person appointed to hold office by virtue of Rules, Notifications, or Orders of the National Assembly, the House of Representatives or the Senate, the Secretariat of the House of Representatives or the Secretariat of the Senate and still hold office;

“Parliamentary mass media” means a mass media permitted by the Secretariat of the House of Representatives or the Secretariat of the Senate to report news of the National Assembly;

“Visitor” means a person other than Member of the National Assembly, ordinary parliamentary officials, political parliamentary officials, parliamentary relevant person and parliamentary mass media under this Rule;

“Library staff” means a parliamentary official who has duties or is appointed to maintain information resources and provide service of the National Assembly Library of Thailand;

“Information resources” means books, journals, pamphlets, newspapers, other printed materials, audio-visual materials, multimedia, references, database and other materials provided by the National Assembly Library of Thailand;

“Electronic service” means the use of the National Assembly Library of Thailand electronic library materials via website, online database or other platforms of online media;

Clause 5. The Secretary-General of the House of Representatives shall have charge and control of the execution of this Rule and have powers to issue Notifications, Rules or Orders for execution of this Rule.


Chapter I
Date and Time for the National Assembly Library of Thailand Service

Clause 6. The National Assembly Library of Thailand is open on Mondays-Fridays from 08.30-16.30 hours and closed on traditional official holidays.

In the case where there is sufficient reason, the Director, with the approval from the Secretary-General, shall have powers to make changes for the date and time of the National Assembly Library of Thailand service.


Chapter II
Eligible Persons for the Use and Borrowing of the National Assembly Library of Thailand Information Resources

Clause 7. Eligible persons for the National Assembly Library of Thailand service shall include:

(1) Member of the National Assembly;

(2) ordinary parliamentary official;

(3) parliamentary relevant person;

(4) parliamentary mass media;

(5) and visitor.

Clause 8. The eligible persons under Clause 7 (1) (2) (3) and (4) shall be members of the National Assembly Library.

Clause 9. Membership of the National Assembly Library ends upon vacating office of Member of the National Assembly, ordinary parliamentary official, political parliament official, parliamentary relevant person or parliamentary mass media as the case maybe.

Clause 10. Rules and procedures for borrowing and returning the library information resources:

(1) A borrower must borrow by using his or her own member code as specified by the National Assembly Library of Thailand, and return the resources within a due date and timing period;

(2) The National Assembly Library of Thailand reserves to require a borrower to return the library information resources prior to expiration date if necessary;

(3) Upon an extension of the borrowing period of the library information resources, a borrower can extend one time. In the case where the library information resources are overdue or the fines have not been paid or reserved, the National Assembly Library of Thailand shall cancel the extension thereof;

(4) Upon an electronic or automatic borrowing system, a borrower shall comply with the procedures thereto and submit a borrowing record for checking-out books.

Clause 11. The eligible persons for the National Assembly Library of Thailand service pursuant to Clause 7 (1) (2) (3) and (4) shall have the rights to borrow the library information resources as follows:

(1) Member of the National Assembly can borrow the library information resources not exceeding seven items. The time limit for the borrowing is fourteen days.

(2) Ordinary parliamentary official, political parliament official, parliamentary relevant person, and parliamentary mass media can borrow the library information resources not exceeding seven items. The time limit for the borrowing is seven days.

Clause 12. Rules and procedures on the use of an electronic service shall be consistent with conditions as prescribed by the National Assembly Library of Thailand.


Chapter III
Categories of the National Assembly Library of Thailand Information Resources

Clause 13. The National Assembly Library of Thailand information resources are divided into 3 categories as follows:

(1) Borrowable information resources include books, academic works, research reports/theses, government publications, back issue’s journals, audiovisual materials, and other borrowable information resources according to the National Assembly Library of Thailand’s terms;

(2) Non-borrowable information resources include reference books, rare books, minutes of the parliamentary sittings, current journals, audiovisual materials, and other non-borrowable
information resources according to the National Assembly Library of Thailand’s terms;

(3) Electronic information resources include multimedia, reference information database,complete version database, and other electronic information resources.


Chapter IV
Terms and Conditions for the Use of the National Assembly Library of Thailand

Clause 14. Users of the National Assembly Library of Thailand shall comply with the following terms:

(1) Presenting their identification before entering the National Assembly Library of Thailand according to the National Assembly Library of Thailand’s terms;

(2) Dressing appropriately;

(3) Before entering the National Assembly Library of Thailand, keep materials except for valuable things at the place designated by the National Assembly Library of Thailand;

(4) Before entering the National Assembly Library of Thailand every time, they must wear their ID badges or parliamentary entry permits;

(5) Reading books or using other National Assembly Library of Thailand information resources in the specified place;

(6) Placing used books or National Assembly Library of Thailand information resources on tables or in the place designated by the National Assembly Library of Thailand;

(7) Smoking and bringing food and drink are not permitted in the National Assembly Library of Thailand;

(8) Talking loudly or performing any acts which distracts other people are not permitted;

(9) Dirtying in the precinct of the National Assembly Library of Thailand is prohibited and maintaining books and properties of the National Assembly Library of Thailand is required;

(10) Marking, writing, cutting, tearing pages or otherwise damaging the properties of the National Assembly Library of Thailand are forbidden;

(11) No any books or information resources can be taken out of the National Assembly Library of Thailand without borrowing according to the regulation or permission from the staff member;

(12) Before leaving the National Assembly Library of Thailand every time, materials which will be taken out of the National Assembly Library of Thailand to the staff member must be shown.


Chapter VI
Duties and Liabilities of the Users

Clause 15. With regard to the use or borrowing of information resources, the member of the National Assembly Library of Thailand must be responsible for:

(1) presenting only his or her member code for using the National Assembly library of Thailand services;

(2) returning information resources within the specified date and time. In case failing to return those resources, the borrower shall pay a fine of five Baht per item per day as from
the day following the due date of the borrowed information resources for delay of returning each information resource;

(3) damage or loss of a borrowed information resource in any case shall be the borrower’s responsibility and the borrower has a duty to examine the completeness of all information resources before borrowing them every time. In case where the borrower finds the defect, he or she must notify the staff member thereof, otherwise he or she must be liable for such defect;

(4) irreparable damage or the loss of an information resource incurred by himself or herself; provided that the user or the borrower replaces such information resource with the same category of the information resource or the same kind or type of the updated information resource having same or better quality within seven days as from the date on which the staff member notifies him or her of the damage or loss. In case he or she cannot provide the substitute within the specified period, he or she shall pay double compensation. In case where the price of the information resource cannot be set, the director shall have power to set and evaluate the price of such information resource. The additional expense for the performance of the National Assembly Library of Thailand of fifty Baht must be paid regardless of compensation methods.

(5) In case of the information resource or fine defaulting or in case where other damages are charges, the staff member will give notice to the borrower. If no reply is done, the National Assembly Library of Thailand will notify the borrower’s affiliation of the default or outstanding payment in writing and request it to deduct the borrower’s salary or reward and return the information resource to the National Assembly Library of Thailand.

(6) In the case where the borrower has already paid damage fees under (4) or (5) and found the information resource later, he or she cannot claim such information resources or paid fees back.

(7) Taking the unborrowed or unpermitted information resource out of the National Assembly Library of Thailand is criminalized. When this illegal act is committed, the staff member shall have the power to execute as provided in Clause 18.

(8) In the case where the information resource is lost and the borrower notifies the loss after the due date, he or she must be liable under (4) or (5) and pay a fine under (2).

(9) The paid fine or operational expense cannot be claimed back in any case.


Chapter VI
Staff Member Operations

Clause 16. In the case where the membership of the member of the National Assembly Library of Thailand terminates under clause 9, the member who borrows the National Assembly Library of Thailand information resources shall return all borrowed information resources within seven days as from the date of termination of membership of the National Assembly Library of Thailand.

In case the member of the National Assembly Library of Thailand fails to return the borrowed resource information within the specified period under paragraph one, the staff member of the National Assembly Library of Thailand will give a written default notice to the borrower and the borrower must pay a double fine of a price of each borrowed information resource.

Clause 17. Collecting and receiving money concerning the National Assembly Library of Thailand services shall be subject to relevant regulations.

Clause 18. In the case where the user of National Assembly Library of Thailand violates or fails to comply with this Parliamentary Rule, the staff member shall perform as follows:

(1) give warning;

(2) expel the user from the National Assembly Library of Thailand;

(3) announce any behavior offence;

(4) deprive of the user’s right to the National Assembly Library of Thailand for three consecutive months.
